Terms and Conditions

1. General & Agreement to Terms of Use 

This website is operated by 3DBioCAD. BY USING THIS SITE AND ALL OTHER ASSOCIATED SITES AND SUBSIDIARIES LINKED TO www.3dbiocad.com, YOU AGREE TO THESE TERMS AND CONDITIONS; IF YOU DO NOT AGREE, DO NOT USE THE SITE 

3DBioCAD, at its sole discretion, reserves the right to change or modify these Terms and Conditions at any time. You are responsible for checking these Terms and Conditions for any modifications and changes. These Terms and Conditions or any future modifications to these terms constitute the agreement between 3DBioCAD and you, and any deviating agreements shall require a written consent from 3DBioCAD. 

2. Quotes and Published Prices 

Any offers and quotes made by 3DBioCAD for products and services are non-binding. 

All published prices are listed excluding any sales tax, and the prices applied to any orders shall be the prices in force on the day of the order, unless agreed to in written consent from 3DBioCAD. Published prices are subject to change at any time without notice and 3DBioCAD reserves the right to change, suspend, or discontinue services at any time without notice.   

3. Purchase Orders and Contracts  

All purchase orders must be approved by 3DBioCAD in a form specifying products and/or services along with any appropriate customer information. The approval or rejection of purchase orders is solely up to 3DBioCAD’s absolute discretion, for any reason. 

4. Returns & Exchanges 

Only items that arrive defective or damaged are eligible for returns and/or exchanges at 3DBioCAD’s sole discretion. Buyer must notify 3DBioCAD to request an RMA (Return Merchandise Authorization) within thirty (30) days from the delivery date, as all returns and exchanges require an RMA. Buyer must provide sufficient evidence of pre-delivery damages or defects as requested by 3DBioCAD (photos, videos, etc.). 

All eligible returns and exchanges must be unused, in original packaging, and not a sale item. Buyer is responsible for original AND exchange shipping and handling costs. All eligible returns will be refunded as credit to Buyer’s account and are subject to a 20% restocking fee. 

All custom order sales are final and ineligible for return. 

5. Governing Law 

These terms and conditions and any other agreements with 3DBioCAD relating to product purchases or services shall be governed by and construed in accordance with the laws of Kent, Washington. 3DBioCAD reserves the right to initiate court proceedings against Buyers at any other court of appropriate jurisdiction.

6. Shipping and Handling 

All purchases require an accurate name of Buyer and shipping address of Buyer. The shipping dates provided to Buyers are estimates, unless expressly agreed to in writing from both parties to a fixed schedule. 3DBioCAD guarantees reasonable efforts to meet estimated delivery times conditioned upon Buyer’s timely provision of all necessary information. In the case of delays in shipment, 3DBioCAD is not responsible for any damage or losses. At Buyer’s risk, 3DBioCAD will store and handle items if Buyer is responsible for delays in shipment. Buyer being responsible for storage, insurance, and handling charges. 

 Delays resulted from force majeure release 3DBioCAD from estimated delivery dates and expressly stated delivery dates or periods. Buyer may only withdraw from contract after a reasonable grace period in the event of non-compliance with contractually agreed delivery periods and dates. 

7. Limitation of Liability 

3DBioCAD is not liable for any indirect, incidental, or consequential losses in damages, injuries, profits, or expenses due to breaches of obligations whether based on contract, tort, strict liability or otherwise.  

8. Indemnity 

Buyer agrees to indemnify and hold harmless of 3DBioCAD and its interns and employees, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers harmless from any demands or claims, including legal fees, arising out of third-party’s breach of 3DBioCAD’s Terms and Conditions, or in violation of any laws and regulations. 

9. Tax 

In the case of local law requiring 3DBioCAD to collect taxes from Buyer, the tax will be added and shown on the invoice as Buyer’s responsibility to pay. If Buyer has a valid tax exemption certificate, it should be provided before final approval of purchase.  

10. Payment Terms 

Unless otherwise agreed by 3DBioCAD, all purchase transactions from our site are COD (Cash on Delivery), meaning immediate payment is required before an order can be shipped as shown on the invoice.  

11. Export Control 

In the case of where products or services are subject to specific export control regulations in any country, Buyer is solely responsible for compliance with their respective country’s laws and regulations. Buyer acknowledges that 3DBioCAD is indemnified and held harmless from any violations of export restrictions.
